These Terms govern purchases from and use of the ShamROCK Audio website and store, operated by Fitzgibbons Audio Recording, LLC, an Arizona limited liability company doing business as ShamROCK Audio. By placing an order you agree to these Terms, our EULA, and our Privacy Policy.
Orders are processed by Lemon Squeezy, which acts as our merchant of record and is the seller of record for the payment transaction. Lemon Squeezy calculates, collects, and remits applicable sales tax and VAT, and its terms govern the payment transaction, taxes, and billing. Notwithstanding that arrangement, your license to use the Software is granted by ShamROCK Audio and is governed exclusively by our EULA. Where Lemon Squeezy's terms and the EULA both appear to address your rights in the Software itself, the EULA controls.
1. Products
We sell downloadable audio software (plugins and instruments), licensed under our EULA. System requirements are listed on each product page; because all sales are final (see section 4), it is your responsibility to confirm compatibility before purchase.
2. Orders & Payment
- Prices are listed in US Dollars (USD) and exclude any taxes that may apply in your jurisdiction.
- Payment is processed by Lemon Squeezy as merchant of record (see section 1). Your order is confirmed once payment is authorized.
- On successful payment you receive a license key by email, which you redeem in the ShamROCK Audio Installer & License Manager.
- If your key does not arrive, check your spam or junk folder first, then email support@shamrockaudio.com from the address you used to order, quoting your Lemon Squeezy order number. If we are unable to issue your key, you have not received what you paid for, and you may ask for a refund under section 4.
3. License & Delivery
Products are delivered electronically. Each license includes activation on up to three machines and free lifetime updates, as described on the product page and in the EULA. The "Shamrock Bundle" grants the full current suite under a single license.
4. All Sales Final — No Refunds
All sales are final. We do not offer refunds ourselves, except in the three cases named at the end of this paragraph. Our products are digital downloads. Supply begins as soon as your order is completed and your license key is issued to the email address on your order; from that point the sale is complete and the product is not exchangeable. The three exceptions are: (a) software that is faulty or is not as we described it, below; (b) a refund granted by Lemon Squeezy under its own policy, below; and (c) if you are an EU or UK consumer who was not asked to give up your 14-day withdrawal right before paying, see the box below.
Because you cannot return a digital download, please make sure a product is right for you before you buy: review the specifications, formats, and system requirements listed on each product page, and confirm compatibility with your system and DAW.
Lemon Squeezy, not ShamROCK Audio, is the merchant of record for your purchase (see section 1), and it applies its own refund policy to your order. Under Lemon Squeezy's Buyer Terms, refunds are granted at Lemon Squeezy's sole discretion, are considered case by case, and may be refused; Lemon Squeezy may also decide to issue a refund on its own initiative. Where Lemon Squeezy's policy applies to your order, that policy governs and we abide by Lemon Squeezy's decision. "All sales are final" is our own position as the company that licenses the software to you. It does not restrict Lemon Squeezy, and it does not stop you raising your order with Lemon Squeezy. Lemon Squeezy's Buyer Terms are published at lemonsqueezy.com/buyer-terms.
How to ask for a refund. Email support@shamrockaudio.com from the address you used to order, quoting the Lemon Squeezy order number on your receipt, and tell us what went wrong. If the problem is faulty or non-conforming software, we deal with it under the next paragraph. Otherwise we will pass your request to Lemon Squeezy, which decides it under its own policy — we do not make that decision and we cannot promise the outcome. You may also raise your order with Lemon Squeezy yourself, using the contact route in its Buyer Terms, instead of or as well as contacting us; asking us first takes nothing away from you.
Faulty or non-conforming software. "All sales are final" does not apply to software that is faulty or that does not do what we described it as doing, and it does not apply if you paid and we never issued your license key. Email support@shamrockaudio.com with your order number and a description of the problem. We will first try to repair or replace the product within a reasonable time and without significant inconvenience to you. If we cannot repair or replace it, you may ask for a refund of what you paid for that product, and we will arrange that refund through Lemon Squeezy. If you bought a bundle and one product in it cannot be repaired or replaced, you may ask for a refund of that product's share of the bundle price — or of the whole bundle, if without that product the bundle no longer does what it was described as doing. This paragraph applies in addition to, and does not limit, any right you have under the law of your country that cannot be excluded.
EU/UK customers — immediate delivery & withdrawal right: Consumers in the EU and UK normally have a 14-day right to withdraw from a distance contract. For digital content supplied immediately, that right is lost once supply begins with your express prior consent and acknowledgement. On our website you are asked to expressly request immediate delivery and to acknowledge that you thereby lose your 14-day right of withdrawal. If you do not give that consent, do not complete the purchase. If you were not asked for that consent before paying, your 14-day withdrawal right is not lost and you may cancel within 14 days for a full refund. This clause does not affect any other statutory rights you have, including rights in respect of faulty digital content, which cannot be waived.
Nothing in this section excludes, limits, or waives any right you have under applicable consumer-protection law that cannot lawfully be excluded, limited, or waived. “All sales final” is our contractual policy; it does not and cannot override a non-waivable statutory right.
5. Acceptable Use of the Site
You agree not to misuse the site, attempt to gain unauthorized access, scrape beyond reasonable use, or interfere with its operation.
6. Intellectual Property
All site content, branding, logos, copy, and product names (including "ShamROCK Audio," "ShamPIPES," "FITZ PHONE," "DeWHALER," "ShamPRESSOR," "ShillelaghDRIVE," and "EQ-GLP1") are owned by Fitzgibbons Audio Recording, LLC or its licensors and may not be used without permission.
7. Disclaimers & Liability
The site and products are provided "as is." To the maximum extent permitted by law, our liability arising from a purchase is limited to the amount you paid for the relevant product. Nothing limits liability that cannot be limited by law.
8. Governing Law
These Terms are governed by the laws of the State of Arizona, USA, subject to any mandatory consumer protections of your country of residence. The state and federal courts located in Maricopa County, Arizona shall have exclusive jurisdiction.
