Fitzgibbons Audio Recording, LLC, an Arizona limited liability company doing business as ShamROCK Audio ("we," "us"), respects your privacy. This policy explains what we collect, why, and your rights.
1. Information We Collect
Information you provide
- Purchase information — name, email, and billing details when you buy a product. Payments are processed by Lemon Squeezy, our merchant of record, which handles the transaction and holds your payment details under its own privacy policy; we never see or store your card number.
- Support and contact — any information you include when you email support or sign up for our newsletter.
- Checkout consent records (historic). Until 2 September 2026, buyers placing an order through the checkout on this website were asked to tick a box expressly requesting immediate delivery of their download and acknowledging that they thereby lost the statutory 14-day right of withdrawal, and we stored a record of that acknowledgement. We no longer ask for that acknowledgement, and no new records of this kind are created. We still hold the records made before that date. Each contains the order number, the buyer's email address, the product, the date and time the box was ticked, and the exact wording shown (stored in full, together with a checksum of it). We did not store IP addresses for this purpose. The records are held with our licensing provider, Keygen, alongside the licence. Our lawful basis for keeping them is our legitimate interest in establishing and defending legal claims (UK/EU GDPR Article 6(1)(f)); we do not rely on consent as the basis for keeping the record itself. We keep them for six years from the date of the order — the limitation period for contract claims in Arizona and the UK — and you may ask us to erase yours sooner at support@shamrockaudio.com, which we will do unless we still need it to defend a claim.
- Marketing preference (historic). Until 2 September 2026 our checkout also offered a separate, optional box asking to be sent ShamROCK Audio news and offers. That box is no longer offered, and we no longer collect a marketing preference at checkout. Where a preference was recorded, it is held with the checkout consent record described above, at our licensing provider, Keygen, for the same six years; your order itself is processed by Lemon Squeezy, our merchant of record, and this website is hosted and served by Cloudflare. If you asked to receive our emails you can withdraw that at any time using the unsubscribe link in every email, or by writing to support@shamrockaudio.com; we stop emailing you as soon as you unsubscribe, and we keep your address on a do-not-email list so that we can honour that. How we decide who receives marketing email now is described in section 2.
- Beta signup information — if you apply to be a beta tester, we collect your name, email address, and phone number (phone is optional), along with the date of your submission and your consent acknowledgment. We use these details only to contact you about the ShamROCK Audio beta and launch — applying does not guarantee a testing slot. We do not sell or share this information, and we do not use it for unrelated marketing without your separate consent. Applications are stored in an access-restricted spreadsheet available only to the company owner and those administering the beta program. You can ask us to remove you from the beta list at any time by emailing support@shamrockaudio.com, and every beta email includes an unsubscribe option.
Information collected automatically
- License activation data — when you activate a license, the License Manager sends a machine fingerprint (a derived identifier based on your computer's hardware/OS attributes) and your license key to our licensing provider (Keygen) to manage your seat limit. We use this only to authorize the Software and enforce the per-license machine limit.
- Website analytics — if enabled, aggregate, non-identifying usage data (e.g., page views) to improve the site.
2. How We Use Information
- To deliver, activate, and support the Software.
- To process purchases and send license keys and receipts.
- To send you licence, security, and update notices about products you own.
- To send occasional news and offers about our own similar products to customers in the United States, on the basis of the existing customer relationship created by your purchase, which you can stop at any time with one click. We do not currently collect a marketing opt-in at checkout, and we do not send marketing email to customers in the EU or the UK. Every marketing email says who it is from, gives a postal address, is identified as an advertisement, and carries a way to unsubscribe.
- To detect and prevent fraud or license abuse.
- To comply with legal obligations.
3. Sharing
We share information only with the service providers who help us operate, under agreements that limit their use of your data. They are: Lemon Squeezy (checkout, payment, tax — our merchant of record), Keygen (licence keys, machine activations, and the consent records described in section 1), Resend (delivering your licence key and other transactional email), Cloudflare (hosting and serving this website), and our email marketing provider, which sends the news and offers described in section 2 to people who have asked for them. We also use hosting, backup and business-email providers that store this information in the ordinary course of running the company. We do not sell your personal information, and we do not share it for anyone else's marketing.
4. Data Retention
We keep purchase and license records as long as needed to support your license, honor warranties/guarantees, and meet tax and legal obligations. You may request deletion subject to those obligations. Checkout consent records, described in section 1, are kept for six years from the order date. Any marketing preference recorded before 2 September 2026 is kept with the checkout consent record. If you unsubscribe, we keep your address on a do-not-email list for as long as we need it in order to honour that.
Beta signup data is kept for the duration of the beta and launch window, and for no more than 90 days after that window closes, at which point we purge the beta list. If you are not selected, or you ask to be removed, we delete your beta signup details from our active list on request at any time.
5. Your Rights
Depending on where you live, you may have the right to access, correct, delete, or port your data, to object to or restrict processing, and to withdraw consent. To exercise these rights, contact support@shamrockaudio.com. EU/UK users may also lodge a complaint with their local data-protection authority.
6. International Transfers
Your data may be processed in countries other than your own (including by our service providers). Where required, we use appropriate safeguards for such transfers.
7. Security
We use reasonable technical and organizational measures to protect your data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Children
The Software and site are not directed to children under 16, and we do not knowingly collect their personal information.
9. Changes
We may update this policy; the "Last updated" date will change. Material changes will be communicated where appropriate.
