These Terms govern purchases from and use of the ShamROCK Audio website and store, operated by Fitzgibbons Audio Recordings, LLC, an Arizona limited liability company doing business as ShamROCK Audio. By placing an order you agree to these Terms, our EULA, and our Privacy Policy.
1. Products
We sell downloadable audio software (plugins and instruments), licensed under our EULA. System requirements are listed on each product page; it is your responsibility to confirm compatibility before purchase (a free demo is available for evaluation).
2. Orders & Payment
- Prices are listed in US Dollars (USD) and exclude any taxes that may apply in your jurisdiction.
- Payment is processed by our third-party payment provider. Your order is confirmed once payment is authorized.
- On successful payment you receive a license key by email, which you redeem in the ShamROCK Audio Installer & License Manager.
3. License & Delivery
Products are delivered electronically. Each license includes activation on up to three machines and free lifetime updates, as described on the product page and in the EULA. The "Shamrock Bundle" grants the full current suite under a single license.
4. 48-Hour Money-Back Guarantee & 14-Day Demo
We offer a 48-hour money-back guarantee. If you are not satisfied within 48 hours of purchase, contact info@shamrockaudio.com for a full refund. On refund, your license is revoked and you must remove the Software from all machines. We may decline repeated or abusive refund requests, or requests showing evidence of continued use after refund. To evaluate before purchase, a 14-day demo of the Software is available.
Statutory rights: This guarantee is in addition to any non-waivable refund or withdrawal rights you have under applicable consumer law. Note that, for digital downloads, some jurisdictions allow the statutory withdrawal right to be waived once download/activation begins; where that applies, our 48-hour guarantee still governs.
5. Acceptable Use of the Site
You agree not to misuse the site, attempt to gain unauthorized access, scrape beyond reasonable use, or interfere with its operation.
6. Intellectual Property
All site content, branding, logos, copy, and product names (including "ShamROCK Audio," "ShamPIPES," "FITZ PHONE," "DeWHALER," "ShamPRESSOR," and "ShillelaghDRIVE") are owned by Fitzgibbons Audio Recordings, LLC or its licensors and may not be used without permission.
7. Disclaimers & Liability
The site and products are provided "as is." To the maximum extent permitted by law, our liability arising from a purchase is limited to the amount you paid for the relevant product. Nothing limits liability that cannot be limited by law.
8. Governing Law
These Terms are governed by the laws of the State of Arizona, USA, subject to any mandatory consumer protections of your country of residence. The state and federal courts located in Maricopa County, Arizona shall have exclusive jurisdiction.
